Justice Olukayode Adeniyi of the FCT High Court on Monday imposed a hefty N100 million fine on the federal government and the EFCC for unlawfully holding former CBN Governor Godwin Emefiele.
The judge also prohibited the government and its agencies from re-arresting or harassing Emefiele without a court-issued warrant, declaring his prolonged detention by the DSS and EFCC as illegal and unconstitutional.
The judge criticized the government’s justification for the detention and questioned the probative value of the arrest order obtained from a Chief Magistrate Court in Wuse, Abuja.
He admonished security agencies for arresting and detaining suspects before conducting investigations.
