On Tuesday, Apple appealed the import ban on its watches following a complaint from Masimo.
The company also submitted an emergency request to the U.S. Court of Appeals to halt the ban until Customs and Border Protection assesses redesigned watch versions for patent infringement.
Masimo alleges Apple stole its pulse oximetry tech for the Apple Watch.
The U.S. International Trade Commission’s order prohibits Apple Watches using blood-oxygen level tech.
Despite Apple’s disagreement, the U.S. Trade Representative upheld the ban, stating it became final on Dec. 26.
Apple has paused sales of affected models in the U.S., awaiting a Customs decision on Jan. 12.
The ban excludes the Apple Watch SE and previously sold watches. A jury trial in California earlier ended in a mistrial, and Apple has countersued Masimo for patent infringement.
This appeal could prolong the case for approximately a year, according to analysts.
Apple’s wearables business generated $8.28 billion in Q3 2023.
