A second-grade teacher in California who was arrested for being drunk in class will not face charges because it is not illegal to teach while intoxicated, the Sutter County District Attorney’s Office has announced.
Wendy Munson, 57, was arrested at Nuestro Elementary School after her blood-alcohol level was found to be more than twice the legal limit.
Despite failing a sobriety test and having surveillance footage showing her driving to school in an inebriated state, prosecutors could not prove that she was intoxicated during class.
The district attorney, Jennifer Dupre, stated, “While it is highly inappropriate to teach while intoxicated, it is not illegal.” The charges against Munson, which included drunk driving and child abuse, were dropped because prosecutors couldn’t establish that her intoxication would have endangered the children.
Munson is no longer listed as a teacher on the school’s website, and any disciplinary actions taken by the school district are separate from the decision not to pursue criminal charges.
