Just one week after Ashley St. Clair revealed that Elon Musk is the father of her child, she has filed a lawsuit seeking sole legal custody of their son.
On Friday, February 21, St. Clair, 26, submitted a custody petition to the New York Supreme Court, stating that the child, referred to as R.S.C., resides in New York.
St. Clair claims that Musk is the father of R.S.C., born in September 2024. She asserts that Musk was not present during the birth and has only met the child three times, with no involvement in his upbringing. Along with the custody petition, she also filed a paternity petition to establish Musk as the father.
St. Clair explains that she and Musk began a romantic relationship around May 2023, and their son was conceived in January 2024. She says Musk acknowledged his parentage through written messages, including one after R.S.C.’s birth, where Musk expressed his intent to meet the child and made comments like, “If I make a mistake on security, [R.S.C.] will never know his father.”
According to St. Clair, Musk’s interactions with R.S.C. were limited to brief meetings: two hours on September 21, 2024, one hour the following day, and a final 30-minute visit on November 30, 2024. St. Clair also claims Musk sent messages like, “I want to knock you up again,” and “We do have a legion of kids to make.”
Her representative, Brian Glickich, told People, “Ashley St. Clair has filed paternity and custody petitions to protect the best interests of her child,” adding that she had made efforts to work with Musk before taking legal action.
In a social media post, St. Clair had previously shared the news, stating, “Five months ago, I welcomed a new baby into the world. Elon Musk is the father.” She emphasized her desire to protect her child’s privacy and asked the media to respect it, refraining from intrusive reporting.
