A spokesperson for the actor emphasized that a similar lawsuit in 2020 was dismissed, expressing confidence that the current claims will meet the same fate.
Foxx intends to pursue a claim for malicious prosecution once the allegations are dismissed.
The complaint, filed by an individual identified as Jane Doe, alleges the incident happened at Catch NYC in August 2015.
The accuser claims inappropriate actions by Foxx after requesting a photo.
The lawsuit seeks damages for physical and emotional injuries, anxiety, distress, embarrassment, and economic harm.
